Terms of Use

Effective: 7 May 2026 Version: 1.0

1. Who we are

This website (millwater.consulting) is operated by Millwater Consulting ("Millwater", "we", "us", "our"). Our principal contact is info@millwater.consulting.

2. What this site is for

millwater.consulting is a marketing and information site. It tells you who we are, what we do, and how to engage us. It is not a portal for receiving consulting advice, executing transactions, or providing personal information beyond what's needed to start a conversation.

If you want to engage us, the right next step is the contact form or info@millwater.consulting. Engagements are governed by a separate engagement letter or statement of work — not by these terms.

3. Acceptance

By using this website you agree to these terms. If you do not agree, please do not use the site.

4. Acceptable use

You may use this website for lawful purposes only. You must not:

  • attempt to gain unauthorised access to any part of the site or its underlying infrastructure;

  • introduce malicious code, viruses, or any code intended to damage the site or other users;

  • use the site to transmit unsolicited commercial messages (spam) or content that is unlawful, defamatory, infringing, or harmful;

  • scrape, copy, or reproduce site content for commercial purposes without our written permission; or

  • use the site in any way that interferes with its normal operation or another person's use of it.

We reserve the right to block access to anyone who breaches these terms.

5. Intellectual property

All content on this website — text, graphics, logos, images, code, and the structure and arrangement of the site — is owned by Millwater or our licensors, and is protected by copyright, trademark, and other intellectual-property laws.

You may view the site, share links to it, and quote short passages with attribution for non-commercial purposes. You may not reproduce, republish, or repurpose substantial portions without our written permission.

The names "Millwater" and "Millwater Consulting", together with our logo, are our trademarks. You may not use them without our written permission.

6. Submissions

When you submit information through our contact form or by email, you confirm that:

  • the information is accurate to the best of your knowledge;

  • you have the right to share it; and

  • you grant us permission to use the information to respond to your enquiry and operate our business.

We do not claim ownership of information you submit. Our use of personal information is governed by our Privacy Policy.

7. No professional advice

The content on this website is for general information only. It does not constitute legal, financial, investment, tax, technical, or professional advice. Do not act on anything published here without first taking advice that is specific to your situation.

If you engage us as consultants, the advice we provide under that engagement is governed by the engagement letter or statement of work — not these terms.

8. Third-party links and content

The site may link to third-party websites, services, or content. We do not control, endorse, or accept responsibility for third-party material. Visiting a linked site is at your own risk and subject to that site's terms.

9. Availability and changes

We aim to keep the site available and accurate, but we do not guarantee uninterrupted access, continuous availability, or that every page is current at every moment. We may change, suspend, or discontinue any part of the site at any time without notice.

10. Disclaimers

To the maximum extent permitted by law, the website is provided "as is" and "as available". We make no warranty — express or implied — about the site's accuracy, availability, fitness for any particular purpose, or freedom from defects, errors, or harmful code.

11. Limitation of liability

To the maximum extent permitted by law, Millwater is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) this website — including loss of profits, revenue, data, or business opportunity.

Where liability cannot be excluded, our total aggregate liability arising from your use of the website is limited to USD$100 (or local-currency equivalent).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence.

12. Consumer rights

If you are a consumer in New Zealand under the Consumer Guarantees Act 1993, the Australian Consumer Law, or another consumer-protection regime, those rights apply alongside these terms and prevail to the extent of any inconsistency.

13. Governing law and jurisdiction

These terms are governed by the laws of New Zealand. Any dispute arising from your use of the website will be heard in the courts of New Zealand, except that we may bring proceedings in any court of competent jurisdiction to enforce our intellectual-property rights.

14. Changes to these terms

We may update these terms from time to time. The "Effective" date at the top tells you when the current version was published. Continued use of the site after a change means you accept the updated terms.

15. Severability

If any provision of these terms is held unenforceable, the remaining provisions continue in effect.
